This ½ day course examines the decisionmaking processes required by Florida’s planning and growth management system addressing the following topics:


  • Roles & Responsibilities: What decisions must be made and who makes these decisions? What is the role and responsibility of the elected body, appointed commissions and boards, the planning administrator, departments and agencies, the city/ county attorney?


  • Legislative vs Quasi-judicial: What is the difference between legislative decisions and quasi-judicial decisions? How do the rules of conduct differ? What is substantial competent evidence? What should the decision maker know about ex parte communication and conflicts of interest? How do the sunshine laws affect land use decisions? Does the planning administrator make a recommendation? What role do staff reports play in land use decisions?

  • Procedures: How are land use petitions initiated? How is evidence assembled and how are public records maintained? How are legislative meetings conducted? How are quasi-judicial hearings conducted?
